Visit Digest Terms of Service
These Terms of Service (the "Terms") are an agreement between you and Priyesh Rughani, who operates Visit Digest ("Visit Digest", "we", "us", or "our"). They cover your use of the Visit Digest mobile application (the "App") and related services.
By creating an account or using the App, you agree to these Terms, our Privacy Policy and our Fair Use Policy. If you do not agree, do not use the App. Questions: support@visitdigest.com.
1. What Visit Digest Does
Visit Digest is a personal tool that helps you record your medical appointments (with the consent of the people present), turn the recording into a transcript and a plain-language summary, prepare questions before a visit, ask questions about a past visit, keep track of medications, symptoms and appointments, and share information with people you choose.
2. Not Medical Advice
- Visit Digest does not provide medical advice, diagnosis or treatment. Summaries, Visit Prep, answers to your questions and other AI-generated content are for your personal reference only.
- AI can make mistakes. Transcripts and summaries may contain errors, omissions or misheard words, including in medication names and doses. Always check anything important with your doctor, pharmacist or other healthcare professional, and follow their instructions over anything in the App.
- Not for emergencies. If you think you may have a medical emergency, call 911 or your local emergency number right away.
- Visit Digest is not an electronic health record, is not used by your care team, and does not create a doctor–patient or other professional relationship.
3. Who Can Use Visit Digest
- You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may use the App only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.
- You may create profiles for other people, such as a child or a parent, only if you have the right to manage their health information.
- You are responsible for keeping your sign-in details secure and for activity on your account. Tell us promptly at support@visitdigest.com if you believe your account has been compromised.
- The information you give us, such as your email address, must be accurate.
4. Recording Consent
Recording laws differ by location. Some places, including California and several other US states, require everyone in a conversation to agree before it is recorded. The App shows a consent screen before each recording, but you are responsible for getting any consent the law requires and for complying with the laws where the recording takes place. Do not record anyone who has not agreed.
5. Your Content
- You own your content: your recordings, transcripts, summaries, notes, and the health information you enter.
- You give us permission to store, process and transmit your content only as needed to run the App for you. That includes sending it to the service providers described in our Privacy Policy, such as our AI provider to create transcripts and summaries.
- We do not sell your content, use it for advertising, or allow our AI provider to use it to train its models.
- You must have the right to record and upload the content you add, and it must not break any law or anyone else's rights.
6. Sharing
You decide who you share a profile or visit with and what they can see. Once someone can see your information, they may remember it, copy it or write it down, so only share with people you trust. You can revoke access at any time in the App; revoking stops future access but cannot undo what the person has already seen.
7. Plans, Payments and Subscriptions
- Free: a limited allowance, currently one visit summary, one Visit Prep and five questions. See the Fair Use Policy for current limits.
- Pay as you go: one-time credits, each covering one visit. Credits do not expire, cannot be transferred or exchanged for cash, and do not include Visit Prep or questions.
- Pro (monthly or yearly): an auto-renewing subscription for unlimited visits, Visit Prep and questions, subject to the Fair Use Policy.
- Prices are shown in the App before you buy. Purchases are made through the Apple App Store or Google Play and are charged to your store account.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends. You can manage or cancel your subscription in your App Store or Google Play account settings. Cancelling stops the next renewal; you keep Pro until the end of the period you have paid for.
- Deleting the App or your account does not cancel a subscription.
- Refunds are handled by Apple or Google under their policies. We do not process payments and cannot issue refunds directly, except where the law requires otherwise.
- If we change prices, we will give you any notice the App Store or Google Play requires, and the change will apply from your next renewal.
8. Acceptable Use
You agree to use Visit Digest for your own personal or household health records, as described in the Fair Use Policy. You must not:
- Record people without the consent the law requires, or upload content you have no right to use
- Use the App as a commercial transcription, medical scribing or bulk summarisation service
- Share one paid account with unrelated people, or create accounts to avoid plan limits
- Use bots, scripts or automation, or try to get around limits, security or payments
- Reverse engineer, copy or resell the App, except where the law allows it
- Use the App for anything unlawful, harmful or abusive
9. Changes to the App
We are continually improving Visit Digest, so features and limits may change. If a change materially reduces what a paid plan includes, we will tell you in advance in the App or by email.
10. Ending Your Use
- You can stop using Visit Digest at any time, and delete your account in Settings → Delete Account. What is deleted, and what is kept, is described in our Privacy Policy.
- We may suspend or close an account that seriously or repeatedly breaks these Terms or the Fair Use Policy, or where we must do so by law. Where it is reasonable, we will tell you first and give you a chance to export your data.
11. Disclaimers
We work hard to keep Visit Digest accurate, secure and available, but the App is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that it will always be available, free of errors, or that AI-generated content will be complete or correct. Some places do not allow these exclusions, so they may not apply to you.
12. Limitation of Liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for decisions made based on AI-generated content. Our total liability for any claim relating to the App is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under the laws of the place where you live.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in California, unless the law where you live gives you the right to bring it in your local courts. If you live outside the United States, you keep any mandatory consumer protections of your country. Before starting a claim, please contact us at support@visitdigest.com so we can try to resolve it informally.
14. Apple App Store
If you downloaded Visit Digest from the Apple App Store, you and we also agree that:
- These Terms are between you and us only, not Apple. We, not Apple, are responsible for the App and its content.
- Your right to use the App is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
- We, not Apple, are responsible for any maintenance and support of the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the App.
- We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- If anyone claims that the App or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when using the App, such as your mobile data provider's terms.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple may enforce these Terms against you.
If you downloaded Visit Digest from Google Play, your purchases are also subject to the Google Play Terms of Service.
15. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date and tell you in the App or by email before it takes effect. If you keep using Visit Digest after that, you accept the updated Terms. If you do not agree, you can stop using the App and delete your account.
